Owners of the mall, Kohan Retail Investment Group, have avoiding giving up control to to the town of Lanesborough and the Baker Hill Road District. A similar situation happened last July.

The Berkshire Mall Emporium, a giant consignment shop, is set to open June 23 at the former J.C. Penney location.
