Parked in Your Own Driveway? You Can Still Get in Trouble for This in Massachusetts.
A lot of people in Massachusetts know that recreational marijuana is legal here. What a lot of people do not know is how strict the rules are when it comes to your car.
You cannot smoke or consume marijuana in any vehicle. Moving or parked. And yes, that includes a vehicle parked on your own property.
It does not stop there. Per the Massachusetts Cannabis Control Commission, you cannot even have an open container of marijuana or marijuana products in the passenger area of your car while on the road or at a place where the public has access. -cannabiscreative.com
Think about that for a second. It does not matter if the car is not moving. It does not matter if you are sitting in a parking lot. If the public has access to where you are parked and you have an open container of cannabis in the passenger area, you are breaking the law.
The rule is similar to alcohol in that sense. You would not crack open a beer in your car in a parking lot and expect to be in the clear. Same principle applies here.
If you are transporting marijuana, keep it sealed and in the trunk or a area of the vehicle that is not considered the passenger area.
Massachusetts has come a long way on marijuana legalization, but the vehicle rules are firm and the penalties are real. A lot of people learned the alcohol open container law the hard way over the years. Do not make the same mistake with cannabis.
There are plenty of people who genuinely do not know this, I didn't.
