The "An Act Relative to Salary Range Transparency" takes effect in Massachusetts on October 29, 2025. This law mandates greater transparency in job postings for businesses with 25 or more employees by requiring the inclusion of salary or hourly wage ranges in job listings.

Definition of Pay Range

A pay range is defined as the annual salary range or hourly wage range that an employer reasonably and in good faith expects to pay for a position. This requirement applies whether the employer posts the job directly or through a third party. The law does not mandate disclosure of bonuses, commissions, or benefits—only the base salary or wage range.

A pay range must be the annual salary range, or the hourly wage range, that the employer “reasonably and in good faith” expects to pay for the role. -sullivanlaw.com

Additional Requirements for Larger Employers

Employers with 100 or more employees must submit annual pay data reports to the state, including demographic information. These reports will be aggregated for public reporting to promote wage fairness and transparency.

Penalties for Non-Compliance

Employers who fail to include pay range information in job postings have two days to correct the violation. Repeat offenders may face fines of up to $25,000.

Purpose and Impact

The law aims to:

  • Ensure fairer wage information for job seekers.

  • Increase transparency in hiring processes.

  • Reduce wasted time for candidates by providing upfront salary expectations.

This legislation addresses past frustrations, such as discovering a job’s pay range only at the end of the hiring process, fostering a more equitable and efficient job market.
