It didn't take long for an arrest to be made in regards to the shooting that took place early Tuesday morning at October Mountain. It also didn't take long for the alleged shooter to appear in court to gave multiple charges.

The Berkshire County District Attorney's Office confirmed the Tuesday afternoon arrest of 19-year-old Kevin Nieves of Pittsfield in connection with the shooting. The arrest was made at approximately 3 p.m.

Nieves appeared in Central Berkshire District Court on Wednesday and was charged with one count each of armed assault with intent to murder, illegal possession of a firearm, kidnapping and assault and battery. Judge Jacklyn Connly ordered Nieves held without bail.

At approximately 1 a.m. on Tuesday, police received a 911 call reporting a shooting near Ashley Reservoir in Washington.  A 19 year old man, who had been shot, was transported to Berkshire Medical Center, in Pittsfield, where he underwent surgery.  He is listed in critical condition in the intensive care unit of the hospital.

The investigation is ongoing and is being conducted by state police detectives assigned to the District Attorney’s Office, the Massachusetts State Police Crime Scene Services and Ballistics Sections, forensic scientists assigned to the State Police Crime Laboratory, state troopers from the Lee and  Cheshire barracks, members of the Pittsfield, Dalton, Washington and Hinsdale Police Departments and the Berkshire County Sheriff’s Department.
