In a statement released by the Berkshire District Attorney's Office, a N.Y. man has pleaded guilty in Berkshire Superior Court to single counts of posing or exhibiting a child in a state of nudity or sexual conduct, and aggravated indecent assault and battery on a child under the age of 14.

The incidents are said to have occurred in Pittsfield on Jan. 1, 2018 and involved an 18-month-old boy.  Montana was arrested at his home by NY State Police in August of 2018 when he was a fugitive in Pittsfield.
Judge John Agostini sentenced Gary Montana, 33, to 13 to 18 years in state prison. The charges relate to acts committed on January 1, 2018, in Pittsfield and involved an 18-month old child. Assistant District Attorney Joseph Yorlano prosecuted the case and recommended 15 to 18 years. The defense asked for 10 years plus five years of probation.
