A second arrest was made in connection with the incident at October Mountain and on Tuesday, that individual was arraigned.

According to the Berkshire County District Attorney's Office, 23-year-old Luis Delvalle-Rodriguez from Pittsfield appeared in Westfield District Court on several charges in connection with the incident that took place in the early morning hours of Aug. 21. A 19-year-old was left in critical condition. It is alleged that Delvalle-Rodriguez assaulted the victim in Washington.

Delvalle-Rodriguez had not guilty pleas entered on his behalf for one count each of armed assault with intent to murder, kidnapping and assault and battery by means of a dangerous weapon. Judge Bruce Melikian ordered that he be held at the Berkshire County House of Correction without the right to bail until Sept. 11 when a dangerousness hearing will be held.

The matter still remains under investigation and during the arraignment, Assistant District Attorney Joseph Yorlano said that he expects "others may be charged" in connection with the shooting. Just hours after the incident took place, 19-year-old Kevin Nieves of Pittsfield was arrested and held without the right to bail after being charged with with one count each of armed assault with intent to murder, illegal possession of a firearm, kidnapping and assault and battery.
